National Consultative Council law along with the Emiri-decree concerning its by-law show the way of the council exercise for the jurisdictions vested with it as follows:

 

Discussion of draft laws:

The chairman refers the draft law submitted by the executive council of the Emirate of Abu Dhabi to the council to look into referring it to the committee that have jurisdiction over its study unless the executive council, mentioning the causes, required the draft law to be urgently considered, then it refers it to the competent committee notifying the council with this. Prior to the discussion commencement, the draft law along with the agenda is distributed among the council members. In case many drafts exist in one subject, the first shall be the origin and the rest shall be its amendment and the reporter of the committee to which the draft was referred shall give the speech to it after the draft and its explanatory note are recited, then to the executive council representative after him and to the members after that. Should the council approve the draft in principle, it shall move to discuss its articles one by one. Subsequently, the opinion shall be taken for the draft in whole. During the discussion, any member may suggest introducing any amendment or omission on its articles and that should be done at least twenty four hours prior to the session in which the draft amended articles shall be considered. The suggestion should be specific and be notified to the committee which has jurisdiction to consider the draft with its suggested amendments before the session. The council may not pass its resolution approving, refusing or amending the draft except with its members' majority. The attendance majority shall not be sufficient in this regard.

2 – Discussion of public subjects:

The council by-law necessitates submission of a written request signed by five members at least concerning putting a public subject forward to be discussed before the national consultative council. The discussion request shall be submitted to the council chairman who, in turn, notifies the request to the executive council before being recorded in the agenda or referred to the National Consultative Council. In case the executive council has no object to the subject discussion, the council chairman may submit it to the National Consultative Council which may refer it to any committee for the purpose of study and submit its report about it as a preliminary step towards its discussion, making recommendations regarding it and referring it to the executive council. The members who signed the discussion request should attend the session that was determined for consideration, otherwise, such request shall be excluded from the agenda if they fail to appear or abandon it unless such request is adopted by another five members. The executive council may also demand spontaneously a discussion of a specific subject in relation to the country affairs to deliver a statement in before the national consultative council or get recommendations from it in. upon the submission of any subject to be discussed, the national consultative council shall have the complete powers concerning asking for the necessary data and documents needed for it from the concerned bodies or sending for any responsible to inquire about it.

3 – Addressing questions:

The question should be signed by its presenter, written clearly and briefly and includes no indecent phrases that hurt any persons or bodies or cause damage to the commonweal. The question should not be submitted by more than one member. Question addressing should be to the executive council chairman or to a chairman of one department only. Should the inquiring member give the question up or his membership has expired for any reason whatsoever, another member can adopt it or it shall be excluded from the agenda. In case of response to the question during the council vacancy, such responses are notified to the national consultative council chairman who, in turn, transmits them to their addressers. Responses to such questions are not restricted to the dates determined during the council convention and they are to be included in the council first following session.

4 – Petitions and complaints:

Petitions and complaints are submitted to the council chairman. They should be signed by their presenters and free from any indecent phrases and the council chairman refers the submitted petitions and complaints to the committee which have jurisdiction over its follow-up. He shall also notify this timely or in a next session.

5 – Knowledge of international pacts and agreements:

The chairman undertakes to notify the council with the pacts and agreements offered to him by the executive council attached with the governmental statement which is recited to the members timely or in a next session. The council shall have the right to show its remarks about them without making any decisions in regard with the pacts themselves that a copy of which is deposited with the council General-Secretariat.

6 – National Consultative Council committees:

In the beginning of each legislative term, the council constitutes its permanent committees namely:-

  • The preparatory committee which is held prior to each of the council sessions to prepare its agenda.
  • Interior & Defense Committee.
  • Financial and Economic Affairs, Industry and Petroleum Committee.
  • Legislative & Legal Affairs Committee.
  • Health Affairs, Labour and Social Affairs Committee.
  • Education, Agriculture and Information Committee.
  • Municipalities & Public Utilities Committee.
  • Eastern Province Affairs Committee.
  • Western Province Affairs Committee.

The council shall have the right to constitute other permanent or temporary committees as per work needs and to lay down provisions concerning each committee as it deems proper.

7 - The council committees' work mechanism:

  • In the beginning of each legislative term and the council having constituted its committees, each committee elects a head and a reporter from its members. It shall also have a secretary from the council officials. In case of the head's absence, the reporter shall serve as a substitute for him. In case of the absence of both, the eldest of the attendance shall take their place. The council chairman shall undertake to call the committees for a meeting till their heads are elected.
  • The council sessions shall be confidential and be held in the presence of the members' absolute majority. Each meeting shall have a minutes briefing discussions, taking resolutions down and be signed by the committee head and reporter. Each of the council's members shall be entitled to attend the committees' sessions in which he is not a member only with the committee consent provided neither to intervene in the discussion nor to show any remarks.
  • Committees are convened upon its heads' calling or upon the council chairman calling. They should be convened if so required by the members' majority and the committee convocation shall be at least 24 hours prior to its convention. The agenda shall be sent to the members.
  • The council refers the subject needed to be studied and discussed to the committee. The committees shall have the right, through the council chairman, to ask for the presence of the department competent head in order to consider the subject brought before it. In such case, the department head or its deputy should be present and he shall have the right to accompany one of the senior competent officials or experts provided that neither the department head nor his companion shall have a vote in the committee deliberation; however, their opinions shall be recorded in the report.
  • Committees can participate in discussing one subject and hold a joint meeting among them with the consent of the council chairman. In such case, the committee head and reporter shall be the oldest of the chairmen and reporters. The joint meeting to be valid, at least the members' majority should be present. Resolutions are passed by the members' majority approval.
  •  A report about each subject referred to the committee briefing its works and showing its recommendations is referred by the committee to the council within two weeks from the subject referral. If the report submission reoccurred to be beyond the appointed time, the council may give another period or decide to settle the subject directly without waiting for the committee report.
  • The committee final report shall include the originally proposed project, the project ratified by the committee and the reasons upon which their opinion was based. The report should also include the minority opinion.
